(direct) or any of Smartee Pants Clothing Company’s wholesalers or retailers is entirely at customer’s own risk. Services/products are provided “as is” without warranty of any kind, either express or implied, including without limitation any warranties concerning the availability, accuracy or content of information, products or services. Many items include embellishments and are hand made. This disclaimer of liability applies to any damages or injury caused by any failure of performance, defect, negligence or under any other cause of action. Customer specifically acknowledges the service is not liable and the risk of injury rests entirely with the customer/recipient. Neither the service(s)/item(s) nor any of it’s agents, affiliates or contract providers shall be liable in any way for any direct, indirect, incidental, special or consequential damages arising out of the use of the service(s)/product(s) or inability to gain access to or use the service or provisions of this section shall apply to all content on the service(s)/product(s).
